AI chatbots on WhatsApp in 2026: what Meta's AI Provider rules allow for your business
Yes, an Indian business can still run an AI chatbot on WhatsApp in 2026 if it serves its own customers, for example answering product questions, bookings or order status. What Meta barred from 15 January 2026 are general-purpose AI assistants offered by AI companies, such as a ChatGPT-style bot for any topic. In India that ban applies; businesses using AI for support are not affected.
Prices as on 22 October 2026. Figures were checked against the provider's official pages on that date. Providers change prices and rules without notice, so confirm on the official page before you budget. Convo360 adds no markup: you pay the provider directly with your own account. Convo360 is not affiliated with Meta or WhatsApp. This is a summary of published sources on the date shown, not legal advice. Meta's own terms prevail.
- Meta's January 2026 terms target AI Providers offering general-purpose assistants, not businesses using AI for their own customers.
- General-purpose assistants are permitted only where Meta is legally required to allow them; India was not on that list as on 22 October 2026.
- Replies written by your own AI agent are billed by Meta as service messages, after 1,000 free per number each month.
- Keep your bot on your business topics, answer from your own content and always offer a route to a human.
- Meta's own Meta Business Agent is a separate, token-billed option; a third-party AI bot is still allowed.
What Meta changed, in plain words
In October 2025 Meta added a section on AI Providers to the WhatsApp Business Solution terms. It applied to new users from 15 October 2025 and to everyone from 15 January 2026. Meta defines AI Providers as providers and developers of artificial intelligence technologies, such as large language models, generative AI platforms and general-purpose AI assistants, who offer services on the WhatsApp Business Platform.
According to Meta's AI Providers pricing page, since that date AI Providers may offer general-purpose AI assistants on the platform only where Meta is legally required to permit it. When the rule took effect, OpenAI, Perplexity and Microsoft announced that their WhatsApp chatbots would stop working, as TechCrunch reported.
The key point for a business owner: Meta told TechCrunch that the change does not affect businesses using AI to serve their customers on WhatsApp. A travel agency running a support bot, its example, is not removed from the platform.
Where general-purpose AI assistants are still allowed
After competition regulators acted, Meta lists the markets where it is legally required to let AI Providers reach users, and charges them separately for service messages in some of them. As on 22 October 2026, Meta's page shows:
| Market | Allowed from | Meta's charge to AI Providers |
|---|---|---|
| Italy | 16 February 2026 | Charged until 12 May 2026, free since 13 May 2026 |
| Other EU and EEA countries | 11 March 2026 | Charged until 12 May 2026, free since 13 May 2026 |
| Brazil | 11 March 2026 | Charged per Meta's AI Provider rate card |
| Turkiye | 15 October 2026 | Not charged, through at least 11 April 2027 |
India is not on the list. So a general-purpose assistant that answers anything for anyone cannot be offered to Indian users through the WhatsApp Business Platform. Meta notes that these rules do not change how it charges every other business.
Business AI versus a general-purpose assistant
Meta has not published a checklist, so the safe reading is about purpose. Your bot is a business tool when AI supports your service, not when the AI itself is the product you are selling.
| Usually fine | Likely to be treated as general-purpose |
|---|---|
| A clinic bot that books appointments and answers timing and fee questions | A number that promotes itself as free ChatGPT on WhatsApp |
| A D2C store bot that answers size, COD and delivery questions | An open assistant that writes essays, code or poems for anyone |
| A coaching institute bot that explains courses and collects enquiries | A paid AI subscription delivered entirely inside WhatsApp |
If your number exists to sell AI chat to the public, take the rule seriously and read Meta's terms with a lawyer. If it exists to sell your sarees, flats or courses, the rule is not aimed at you.
The rules that do apply to your AI bot
- The 24-hour window. Your AI can reply freely only inside a customer service window that the customer opened. Outside it you need an approved template. See the 24-hour window explained.
- Billing. Meta counts replies from a human agent and from a third-party AI alike as service messages. From 1 October 2026 they are charged at India's service rate of INR 0.115 per delivered message, after 1,000 free per business phone number each month, with no roll-over.
- A route to a human. WhatsApp's Business Messaging Policy allows automation but requires clear escalation paths to a person, such as an agent transfer, phone number or email.
- No sensitive data. The policy says not to ask customers for full card numbers, financial account numbers or ID numbers in chat.
- Accuracy. The bot speaks for your business. Ground it in your own content to limit hallucinated answers.
Keeping your AI agent clearly business-focused on Convo360
On Convo360 you build the AI agent yourself and connect your own OpenAI, Anthropic Claude or Google Gemini key. Convo360 adds no markup on AI tokens or Meta messages. To keep the agent firmly in the business-AI category:
- Write a scoped system prompt. State what the agent helps with, for example orders, prices and bookings for your store, and tell it to politely decline unrelated requests. See how to write a system prompt.
- Add a knowledge base. Upload your price list, policies and FAQs, or add your website URL, so answers come from your content.
- Give it real actions. In the Flow Builder, connect the AI Reply block to bookings, Razorpay payment links or Save CRM lead, so the bot does business tasks.
- Keep a human in the loop. Use the live-chat inbox; the bot pauses when a team member replies.
- Or skip AI entirely. A guided bot answers with buttons and menus and needs no AI key at all.
What about Meta's own AI agent?
Meta also launched Meta Business Agent on 1 July 2026, its own AI agent for business conversations on WhatsApp. It is billed differently: per token, at a global rate of USD 2 per million tokens since 1 August 2026, which Meta estimates at about 4 to 5 US cents per message. Using it is optional. A business-run third-party AI agent remains allowed and is billed as ordinary service messages. We compare the two in Meta Business Agent versus your own AI chatbot.

Frequently asked questions
Are AI chatbots banned on WhatsApp in 2026?
No, not for businesses serving their own customers. Meta's January 2026 terms bar AI Providers from offering general-purpose AI assistants on the WhatsApp Business Platform, except where Meta is legally required to allow them. Businesses using AI for support, sales or bookings are not affected.
Can I still use ChatGPT for my business WhatsApp chatbot?
Yes. You can connect an OpenAI, Claude or Gemini model to your own WhatsApp number to answer your customers about your products and services. What is not allowed in India is offering a general-purpose AI assistant to the public through the platform.
Does the ban on general-purpose chatbots apply in India?
Yes. Meta permits general-purpose AI assistants only where it is legally required to. As on 22 October 2026 its list covers Italy, other EU and EEA countries, Brazil and Turkiye. India is not on that list.
Are AI replies on WhatsApp charged by Meta?
Yes, from 1 October 2026. Meta treats replies from a third-party AI as service messages, charged at INR 0.115 per delivered message in India after 1,000 free service messages per business phone number each month. Your AI provider bills its own token charges separately.
Does my WhatsApp AI bot need a human handover?
WhatsApp's Business Messaging Policy allows automated replies but requires clear and direct escalation paths to a human, such as transfer to an agent, a phone number or email. Offering a talk-to-a-person option also builds customer trust.
